Terms of Service

1. Acceptance of Terms

By accessing or using the Tatagan platform ("Service"), operated by Tatagan Technologies ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Tatagan is a cloud-based construction fleet management platform that provides equipment tracking, fuel monitoring, payroll processing, materials management, project finance, and related operational tools for construction companies. The Service is provided on a subscription basis with tiered pricing plans.

3. User Accounts

You must provide accurate and complete registration information. You are responsible for maintaining the security of your account credentials and for all activity under your account. Each organization receives an isolated subdomain (e.g., yourcompany.tatagan.com) with separate data storage.

You must promptly notify us of any unauthorized use of your account. We are not liable for losses caused by unauthorized access that results from your failure to safeguard your credentials.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other organizations' data
• Interfere with the Service's infrastructure or security
• Upload malicious code, viruses, or harmful content
• Resell or redistribute the Service without authorization
• Use the Service to process data in violation of applicable privacy laws

5. Subscription & Payment

The Service is offered through subscription plans (Starter, Professional, Enterprise) with different feature sets and usage limits. Subscriptions are billed in advance on a monthly or annual basis. All fees are in Philippine Pesos (PHP) unless otherwise stated. Late payments may result in service suspension. You may cancel at any time; access continues until the end of your current billing period.

6. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Tatagan Technologies. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service. You retain ownership of all data you input into the Service.

7. Data Ownership & Portability

Your organization's data belongs to you. You may export your data at any time using built-in export tools (CSV, PDF). Upon account termination, we will retain your data for 30 days to allow retrieval, after which it will be permanently deleted.

8. Limitation of Liability

To the maximum extent permitted by law, Tatagan Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted availability. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our control, including internet outages, natural disasters, or third-party service failures.

10. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases, subject to the data portability provisions in Section 7.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be resolved through the courts of Cebu City, Philippines, unless both parties agree to alternative dispute resolution.

12. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
